Abstract

This study examines arbitration in sports disputes, with a focus on the Saudi Sports Arbitration Center and the Court of Arbitration for Sport, including their structure and procedures. A descriptive-analytical and comparative approach was followed to study the different concepts related to the nature of sports arbitration. The study reached several results, most notably: Sports arbitration is a method for resolving sports-related disputes by one arbitrator or a panel of arbitrators, provided that their number is odd, by decisions that are final and carry res judicata authority. The Center holds original and exclusive jurisdiction to adjudicate sports disputes within the Kingdom of Saudi Arabia. The decisions from the Center are considered enforceable executory instruments, thereby enhancing the protection of the parties’ rights, transaction stability, and confidence in arbitration. The Court operates independently of sports bodies and is internationally recognized for its experience in resolving sports disputes. In conclusion, the study recommended several recommendations, including: The Saudi legislature should publish a sports law. Should be issue regulations regulating the procedures related to special and temporary rooms in accordance with international bases and rules. Establish agreements and partnerships with the International Court of Arbitration to benefit from their technical and legal expertise.
