"The Validity of the Electronic Signature in Proving the Electronic Contract "A Comparative Study"

Abstract
This study examines the validity of electronic signatures in proving electronic contracts under Saudi and Qatari legislations, focusing on their equivalence to traditional signatures. The research addresses the central issue of the unclear legal standing of electronic signatures and associated technical and legal challenges. Findings indicate that comparative legislations recognize the validity of electronic signatures when specific conditions are met, such as linkage to the signer and content integrity, though regulatory details vary. The study recommends enhancing legal frameworks for data protection, defining judicial jurisdiction in e-disputes, and updating the definition of electronic signatures to include technical aspects.
